Definitions

• "User" refers to any individual or entity using our platform.
• "Creator" means a user who offers content creation, promotion, or related services.
• "Brand" means a user representing a company or entity seeking collaboration with creators.
• "Content" includes all text, media, data, campaigns, and files uploaded or shared on the Platform.
• "AI Services" refer to automated services powered by machine learning that assist users in managing or optimizing workflows.

Eligibility

You must be at least 18 years old and legally competent to enter into a binding agreement under Indian laws. By using Colecta AI, you represent that:

• All registration information is truthful and accurate
• You will maintain the accuracy of such information
• Your use of the platform does not violate any applicable law or regulation

Account Registration

• You must create an account to access platform features.
• You are responsible for maintaining the confidential of your account credentials.
• You agree to notify us immediately of any unauthorized use or breach of security.
• We reserve the right to suspend or terminate accounts for any misuse or policy violation.

Use of Services

You agree to use Colecta AI:

• Only for lawful purposes
• In accordance with these Terms and applicable Indian laws
• Without infringing the rights of other users

You may not:

• Attempt to reverse-engineer, hack, or manipulate our AI systems
• Post or distribute content that is defamatory, obscene, harmful, or unlawful
• Use another user's account without authorization

Creator–Brand Collaborations

Creators and brands may connect, negotiate, and execute collaborations via the Platform. Colecta AI:

• Facilitates discovery, communication, and campaign tracking
• Provides AI-based campaign suggestions, content management tools, and performance analytics
• Does not guarantee campaign outcomes, engagement, or user responses

All agreements between creators and brands are solely between those parties, and Colecta AI is not a party to these agreements.

Payments & Fees

For Creators:

• Creators may earn revenue from brand collaborations.
• Payouts are made to registered bank accounts after collaboration milestones are completed and approved.
• Colecta may deduct platform fees (e.g., 5–10%) depending on subscription status.

For Brands:

• Brands pay service fees to initiate and manage collaborations.
• All payments are final unless otherwise specified under refund conditions.

All transactions are processed in INR, and applicable taxes may apply.

Intellectual Property

All rights to the platform, including AI models, user interfaces, and branding, are owned by Colecta AI Pvt Ltd.

You retain ownership of content you upload but grant us a non-exclusive, worldwide, royalty-free license to:

• Use, host, reproduce, and display your content to provide services
• Analyze and process data for platform features and improvements

AI Disclaimers

Our AI tools are provided "as-is". While we strive for high accuracy:

• AI-generated insights or suggestions are not professional advice
• We are not liable for decisions made based on AI recommendations
• Users are responsible for reviewing and validating AI outputs

Limitation of Liability

To the fullest extent permitted under law:

• Colecta AI shall not be liable for any indirect, incidental, special, or consequential damages
• We do not warrant uninterrupted or error-free service
• Our total liability shall not exceed the amount paid by you (if any) to use our services in the past 6 months

Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising will be subject to the exclusive jurisdiction of courts in Bhopal, Madhya Pradesh.
